TERMS AND CONDITIONS
- 1. These Terms and Conditions (“Terms and Conditions”) govern the use of the Universal Afir website, accessible at https://www.universalafir.pt/ (“Universal Afir Website”).

UNIVERSAL AFIR, S.A., with registered office at Cova do Frade, parish of Ovar, 3880-020 Ovar, with a share capital of €5,800,000.00, registered under company and legal entity identification number 500 293 473 at the Conservatória do Registo Predial/Comercial de Ovar (“Universal Afir”), is responsible for managing the Universal Afir Website.
- 3. Access to and use of the Universal Afir Website by users (“User”) implies and presupposes full, complete and unconditional knowledge and acceptance of these Terms and Conditions.
- 4. The User expressly declares that they have the legal capacity required by law to fully, completely and unconditionally accept these Terms and Conditions.
- 5. The User acknowledges and expressly accepts that Universal Afir may, at any time and at its sole discretion, amend these Terms and Conditions, such amendments being deemed effective from the date on which they are made available on the Universal Afir Website.
- 6. If the User does not agree with or accept these Terms and Conditions, they should not continue to access or use the Universal Afir Website.
- 7. The entire content of the Universal Afir Website is the property of Universal Afir, including, without limitation, texts, data, images, graphics, sounds, audio, videos, designs, illustrations, trademarks, domains, logos, photographs and all other information, features and content available on the Website, and is protected under applicable law and national and international legislation relating to copyright and intellectual property rights.
- 8. Universal Afir holds all copyright relating to the content of the Universal Afir Website. Copyright protection for all content on the Universal Afir Website extends to any and all copies or reproductions obtained or created from such content, regardless of their type, nature, form, content or means of reproduction or copying.

The User acknowledges and accepts that it is expressly prohibited to publish, reproduce, communicate, copy, disseminate, transmit, distribute, use, disclose, modify, sell, assign, publish or otherwise make available to third parties, by any means or in any form, directly or indirectly, in whole or in part, whether free of charge or for consideration, any content from the Universal Afir Website, for any purpose whatsoever, without the express prior written authorisation of Universal Afir.
- 10. The User acknowledges and expressly accepts that they are not authorised to use the content of the Universal Afir Website for personal purposes and that any alteration of the Website’s content is also prohibited, without prejudice to any mandatory provisions of applicable law.

The User acknowledges and accepts that it is expressly prohibited to restrict or interfere with access to, browsing of or use of the Universal Afir Website, by any means or in any form, directly or indirectly, in whole or in part, or to fail to comply with any applicable rule, regulation or legal or administrative provision relating to access to, browsing of or use of the Universal Afir Website. It is also strictly prohibited to introduce, create, insert, place, transmit or enable access, by any means or in any form, directly or indirectly, in whole or in part, to any virus, worm, Trojan horse, script, program, system or file that has or may have the effect of limiting or destroying, in whole or in part, any functionality or content of the Universal Afir Website.

The User acknowledges and expressly accepts that they are solely and exclusively responsible for any and all loss or damage, whether direct or indirect, including actual loss, loss of profit and non-material damage, caused to themselves, Universal Afir or any third party as a result of the User’s access to or use of the Universal Afir Website.
- 13. The User acknowledges and expressly accepts that Universal Afir does not guarantee the privacy or confidentiality of any information that may be sent or transmitted by the User over the Internet.
- 14. The User acknowledges and expressly accepts that access to or use of the Universal Afir Website may be subject to failures, errors, disconnections and interruptions.
- 15. The User expressly accepts that Universal Afir may amend the content of the Website at any time.
- 16. The User is solely responsible for accessing the Website and complying with applicable legislation.
- 17. The User acknowledges that any breach of these Terms and Conditions may result in civil and/or criminal liability.
- 18. Universal Afir may restrict or block access to the Website in the event of non-compliance with these Terms and Conditions.
- 19. Universal Afir may restrict or terminate access to the Website at any time.
- 20. Any dispute shall be governed by Portuguese law and subject to the jurisdiction of the Court of the Judicial District of Ovar.
